Financial obligations on the inherited property can also trigger a forced sale. “If a decedent left behind significant debts, creditors can place liens on the home, making it difficult to transfer ownership without settling these obligations,” Russ explained. “In many cases, selling the property is the only way to satisfy creditors and fairly divide the remaining assets among heirs.”

Even minor disputes over repairs or updates can push heirs toward selling. “If the costs of upkeep outweigh the benefits of retaining the property, or heirs are financially unable to maintain it alongside their own homes, selling becomes the most practical option,” he said. Market conditions can also influence these decisions.

Resolving disputes amicably requires clear communication and professional guidance. Russ recommends mediation as a pathway for families to negotiate terms without involving the courts.
