Michigan Expungements Attorney Paul J. Tafelski Explains the Possibility of Restoring a Person’s Gun Rights After Expungement

The lawyer mentions that if a person is convicted of a felony in Michigan, they will lose their gun rights. Under Michigan Law, those who are facing felony crimes “possess, use, transport, sell, purchase, carry, ship, receive, or distribute a firearm in this state” until certain conditions are met.

“If your conviction was for another type of felony or other crime punishable by four or more years in prison, you can’t possess, purchase, use, transport, or sell any firearm or ammunition in the state of Michigan until three years after you have served your terms, paid your fines, and completed your probation or parole requirements,” the Michigan expungement attorney says.

Expungement is a legal process that allows individuals to have certain criminal convictions sealed or removed from their criminal record. The goal of expungement is to provide individuals with a second chance and help them move on from their past mistakes. However, the court's ruling makes it clear that expungement does not automatically restore an individual's right to possess firearms.

Under Michigan law, individuals who have been convicted of certain crimes are prohibited from possessing firearms. These crimes include but are not limited to, felonies, domestic violence offenses, and certain misdemeanors. Even if an individual's conviction is expunged, they are still prohibited from possessing firearms if they were convicted of one of these crimes.

In the article, the lawyer adds, “The recent Clean Slate Act in Michigan has also made significant progress in expanding the rights of more individuals with non-violent criminal records to get their records expunged. When you have your record expunged, the court can restore your right to bear arms.”
